How to Write a Video Proposal: Show Creativity to Clients

Video Proposal

You can gain more clients by presenting your project pitch through a video proposal. But to sell your services more effectively, you must know how to do it properly.

In this post, we’ll provide a step-by-step guide on how to draft a video proposal . Along the way, we’ll also give you a free template so you can get started.

Table of Contents

How To Write A Video Proposal

You can employ various approaches to writing a proposal. But to ensure better results, make sure you follow the steps below.

Step 1: Do your research

Businesses can benefit from video production services in various ways depending on their needs. To be able to relate to their needs, you’ll need to study the industry they belong to.

You’ll also need to do a little market research to understand how these businesses connect with their target audiences. Having that information makes the process of drafting a video proposal easier.

Step 2: Choose your services carefully

Pick the services that would be the best fit for the client’s requirements. Remember that not all video content can align with all business needs.

For instance, video ads can be useful for promoting products and services. But if you’re helping your client with credibility and authenticity, you might consider offering interviews, documentaries, or tutorials.

The target audience also matters. A younger demographic may be more receptive to animations and music videos. As for older audiences, they may prefer a more serious fare.

Step 3: Organize your video proposal into sections

Make sure that your video project proposal has an organized flow. To achieve this, we recommend using a template that arranges each section organically.

Of course, it pays actually to know the purpose of each section. More importantly, remember that knowing what section to include isn’t enough. You must also populate those sections with clearly composed sentences supporting your overall project pitch.

Using simple language is always the best approach. Note that your proposal might find its way to CEOs, managers, and business owners.

Most, if not all of them, might have had their share of excessively hyped proposals. When it comes to video proposal creation, get straight to the point. Your potential clients mean business, and so should you.

Step 4: Create a more streamlined video proposal for existing clients

Be more efficient when pitching a new video project to an existing client. You don’t need to use the template you used the first time you proposed to them. In fact, you can cut to the chase with a shorter proposal.

For example, you can do away with formal introductions because you already have a business relationship with the client. Instead, focus on sustaining the success you achieved with your past project. Along the way, make improvements based on what you’ve learned from previous dealings.

Step 5: Be transparent about your video production services

True, it’s always a best practice to highlight the strengths of your team. But always be careful not to promise something that your crew might not be able to deliver.

You can start writing a video proposal by providing information about your professional experience. It would be wise to support this by mentioning past projects pertaining to specific expertise (commercials, music videos, etc.).

You can also specify the video and lighting equipment that you use. The objective here is not to get technical and sound more impressive. The goal is to give your client an idea of the range of tools that you routinely use.

Video Proposal

Essential Elements of Video Proposal

When learning how to create a video proposal, you can do no wrong by memorizing the absolute essential elements that make up a good video proposal. So, which sections should you include?

Introduction

Capture your client’s attention with a good introduction. This section can include an interesting factoid or stat related to video marketing.

The introduction is a brief section that helps you smoothly segue to the next part of the document.

This section is a short summary of who you are and what services you offer. It includes your name, location, and years of experience.

The company’s mission and vision can also be included here. Some other information that can be added is your team members. Share the collective expertise of your team (directors, cinematographers, scriptwriters, etc.).

This is where a clear list of your video production services will be added. As a rule, you should also include the types of video content that you produce.

This section should include your process on how you make a video. This should give your client an idea not only of how you work but also of how you collaborate with clients.

Video Proposal

The timeframe of the entire video production can be laid out in the document. This should include schedules for pre-production, shoots, and post-production.

A clear pricing structure should be included for all the services you provide. Each figure should be properly labeled and broken down, if necessary.

Terms and Conditions

Proper guidelines for business engagement should be listed here. Establishing your terms and conditions not only protects you but also helps avoid potential conflicts in the future.

Always include terms for payment, project scope, and termination for good measure.

This section allows potential clients to affix their signatures to signify their approval of your proposal.

We’re operating in a digital world where one good video can lead to massive business growth or social following. As a more compelling and dynamic form of media, video helps brands tell a better story and leave a more profound impact on viewers. According to reports by Wizowl, 81% of marketers say that video has helped them directly increase sales. Over 90% of marketers say it has helped them increase brand awareness.

Global brands like Reebok, Coca-Cola, Always, Dove, etc have mastered video marketing with the launch of video ad campaigns that tell a warm story and appeal to our emotions. Many other brands have been following this practice and are succeeding. The credit for this goes to smartphones that have provided innumerable opportunities to marketers.

No doubt, videos have become the most popular form of communication integrated into every aspect of existing marketing efforts. With the ability to inform and entertain at the same time, video marketing has that pull factor going for it. Consumers, too, prefer watching a video rather than reading a long column of text. After all, it is an easy-to-digest format that allows our eyes to take a break from the overload of online textual information.

Primary benefits of video marketing for businesses

  • A video on your website can increase conversion and sales
  • It shows a significant return on investment.
  • It helps in building trust through storytelling.
  • Google loves videos and is more likely to rank pages with videos on them.
  • Video is an excellent way to engage with mobile users
  • Videos can explain everything that text cannot.
  • Videos engage even the laziest consumers.
  • Videos get more shares on social media

  • Decide and have a blueprint ready for your project timeline, roadmap, and budget.
  • Make sure that the previous steps are all moving towards the same broad goal you wish to achieve through the video proposal.

How to Write a Video Production Proposal

how to make a proposal video

collaCreating video content requires a very particular set of skills, that can only be mastered through long hours of patient creative effort.

However, a lot of video production companies forget to bring these skills to the table when they're creating their video production proposals. As a result, they find themselves struggling to achieve a professional-looking design, building each proposal from scratch - and not playing to their strengths.

In this guide, we’re going to walk you through the process of building the perfect video production proposal. We’ll help you write a piece of sales collateral that will address your customer’s needs, outline exactly what your customer can expect , and make full use of your video production talents and resources.

What is a video production proposal, and why do I need one?

Gone are the days when a videographer could rely on an email with a link to a showreel to close the deal .

In today’s competitive video production industry, clients expect a streamlined professional service, even from freelance video professionals. That includes a defined sales process , using an effective sales methodology and a videography proposal that’s been created with the same attention to detail, storytelling skill and visual flair that you (hopefully) bring to your video productions.

A video production proposal is a comprehensive document used by video production companies, videographers, video marketing agencies and video production agencies. These are provided for prospective clients based on the information they've provided about their needs or a specific project.

The proposal needs to cover essential information about the deliverables, editing services offered, timeline, cost and payment terms, and terms and conditions. It needs to demonstrate to the potential client why they should choose your company. This can be achieved by sharing social proof (such as case studies, testimonials, details of your industry experience, or awards).

Your proposal is an opportunity to win over prospective clients by showcasing your best video work. This is typically delivered using a demo reel of excerpts from your most visually impressive or relevant videos.

You can see an example below inside our video production proposal template .

Video Production Proposal Template

Land clients with a visually appealing and persuasive video pitch – create a cohesive, creative, and attention-grabbing proposal in just a few minutes.

Video Production Proposal Template

What should I include in my video production proposal?

Video professionals are in a unique position compared to other service companies preparing a sales proposal - they can use their video content to make their proposal stand out.

It’s the perfect showcase opportunity, but you’ll need the right proposal software and templates to work with to systematize your video proposal design.

If you’re looking to create a template for your videography and video production proposals, then there are key ingredients you’ll want to include in every proposal.

Bear in mind that once you’ve got a solid template to work with, you’ll be able to provide all your clients with a fully personalized proposal - even those who you might not normally issue a proposal for, such as your repeat customers.

It’s worth remembering that your repeat customers can still benefit from a sales proposal, even if they’re already familiar with your methods and approach. Greg Ball of Ball Media Innovations, a successful Miami-based production company specializing in corporate video, explains in his blog why he still prepares a full proposal for his repeat customers:

“Never assume that your existing clients aren’t checking out your competition. A proposal gives you the opportunity to remind them and their management why they’ve chosen you in the past and why they should choose you again.”

Here are the elements that any comprehensive video production proposal should include.

  • Executive summary

A summary at the start of your proposal gives your potential client an overview of your company and your approach to their project requirements. It’s also a chance to create a strong first impression to differentiate you and your company from your competitors. You can include contact information here if necessary.

Show the client what makes your company special. Draw on any social proof - reviews, testimonials - and highlight your industry experience and any awards you’ve received. Well-established companies can leverage their client lists here, too - especially if they’ve previously worked with well-known brands or businesses.

You can talk about your crew here - each individual’s industry experiences and track record adds to the impression of the company you’re trying to create for the client.

Our process

The content of this section may vary depending on how much information you already have about the proposed video project, either through discovery calls or a video production RFP.

Even if some of the details (such as timings and location) have already been confirmed, it’s still important to communicate to the client the need for a consultative process . Include this as one of the first steps in your outlined approach. Tell them how you handle pre-production site visits and setup.

Video production is complex, with many variables and moving parts. Describing the process can help the client understand not only the complexity but also how you will handle it for them. Talk about the different types of equipment required, shooting schedules, storyboarding, editing days, music, graphics, and even animation (if it’s relevant to the project). Ideally, you should structure this section with a rough timeline to help the client picture the different stages of the process.

Giving the client this greater awareness of the complexities of video production will also help them appreciate your pricing structures , anchoring their expectations of your fee.

Now is the time to let your work speak for itself. Any professional videographer will be familiar with the concept of a demo reel . They should already know to make sure their reel is snappy, tailored to the project style, and explicitly highlights the technical aspects of the work.

If you really want to make your proposal stand out, then embed your demo reel video right there in the proposal. Then, your prospective client can view your work without leaving the proposal document - increasing the likelihood you’ll close the deal. There’s strong evidence that embedded videos improve conversions across almost every digital marketing format.

It’s unlikely that any discerning client will want to invest in your services without fully assessing the quality and breadth of your portfolio. While the demo reel is designed as a persuasive calling card, it needs to be backed up with a carefully curated selection of longer videos (preferably connected to similar clients or projects).

Again, if you can present this additional content as embedded videos within your proposal, you can maintain better control over the client’s viewing and browsing experience. This should improve your chances of closing the deal .

Your investment

Video production is a resource-intensive service, usually involving multiple locations, long hours on and off-site, and a range of different specialist equipment.

While some of the details will be covered in the T&Cs, it’s a good idea to point out what features are included or excluded from the service in the pricing section of the proposal. This transparent approach lets you set your client’s expectations appropriately - especially if they’re unsure what to expect from video production services.

As most video production client work tends to be a one-off project or intermittent pieces, combining feature-based with usage-based tiered pricing strategies should yield results. The feature-based aspect allows the client to add or remove aspects of the service to suit their budget (for example, additional editing, animations, or original music composition).

The usage-based element of the strategy means that a videographer’s most precious resource - time - can be properly valued. This can be achieved with different packages offering longer or shorter production schedules (charging more for the faster service), a wider travel radius for location shooting, or additional shooting days.

  • E-signature

Providing e-signature functionality within the proposal is another table-stakes feature of any good proposal creation software. As well as reducing the number of steps needed to close the deal, e-sign saves time and money. On average, $36 is saved on every agreement by reducing costs such as postage, printing, and employee time.

Terms and conditions

With the right proposal template software, the terms and conditions can be incorporated in the same way as the e-signature functionality. Clicking ‘Accept’ can take the client through to another page where they can view the T&Cs. This keeps your sales proposal streamlined and visually appealing.

Frequently asked questions about video proposal templates

What is a video production proposal.

A video production proposal is a document submitted by a video production company, videographer, corporate video production company, or video marketing agency to a potential client. Its purpose is to convince a potential client to purchase video services from a video company or professional videographer.

How do I write a videography proposal?

The best videography proposals are concise summaries of why your video services company is the best choice for your potential client. They are brief, convincing, well-written , and organized into sections for easy reading.

This example video production proposal template is pre-written with professional copy that's ready to use or switch out with text of your own.

What makes a good video production proposal?

A good video production proposal must have everything a potential client needs to make an informed decision. It's important to only include necessary information to ensure the proposal remains brief and compelling.

Some videography proposal must-haves include an eye-catching cover, a detailed scope of services, a project timeline, and a statement of work contract to protect your business.

Why not just send my video proposal as a PDF?

If you send your video production proposal as a PDF you run the risk of being totally in the dark as to what happens after you send your proposal. You have no way of seeing how your prospect is interacting with your quote and can miss important cues that could cost you the deal.

Proposify's online proposal software allows you to track and analyze exactly what happens once your videography proposal is in your potential client's hands. You'll have full visibility into how your quote is progressing from the moment you send to the second they sign.

How do I get a video proposal signed?

Electronic signatures are secure, legally binding, and with Proposify, completely free. They are the modern way to close new business. Wave goodbye to printing PDFs or Word docs just to sign with a pen, scan it, and send it back.

Every Proposify proposal template includes our free esignature tool.

Can I edit this video proposal template?

You betcha. All Proposify templates are completely customizable.

How many pages should a videography proposal have?

Our data which we collected from millions of proposals shows that the ideal length for a videography proposal is 11 pages which are organized into 7 sections.

The best video proposals are concise, organized, and include compelling design and visual content to make sure they are impressive to read and easy to navigate and understand.

How should I structure a video proposal?

First thing's first: Let your creativity shine and your unique style shine through by leading with an unmissable cover. Next, persuade your potential client that you are the best video production company for the job with a short executive summary of your services and the value you provide. Then be sure to include a detailed scope of services and timeline so everyone's on the same page with how long the project will take and what is involved. Introduce your team with an About Us section, and show off past wins with a case study. The all-important pricing section needs to have a clear breakdown of your fees. Finally, a statement of work contract will protect your business, and a place for your new client to electronically sign makes it easy to close the deal.

How do I send a video proposal to a client?

There are several ways to get a video production proposal to a client, some more efficient than others. The most efficient way is to make sure your video production quote is online and provide your prospect with a secure link. Then there's no need to download, and your proposal won't get stuck in your client's spam folder.

10 Creative Ways to Propose, With Video Examples

Logan Cross

Coming up with a good, creative idea is hard enough. But coming up with a good idea that involves asking your soulmate to spend the rest of their life with you, one that won’t get messed up in the execution process? Now that… that can seem impossible.

Take a quick look at these 10 creative proposal videos, and you’ll see that coming up with a memorable proposal idea isn’t actually impossible. It just takes a bit of planning and a group of friends or family members who truly believe in you and your partner. We’ve combed through all of the craziest, most creative proposal videos you can find on the web today, and these are our top 10.

If you’re here looking for proposal inspiration, then take note of this one detail we found in all of these videos: the proposal focused on what the groom knew the bride would love. When in doubt, going back to what makes you and your partner tick is important! It doesn’t matter how fancy it is or how much money you spend on it. This is between you and your bride: make it about you two. Here are a few videos to inspire your memorable proposal.

Isaac and Amy’s Live Lip-Dub Proposal

With over 5 million views, we know that we’re kind of late hopping onto this immensely popular and memorable proposal that involves lip-dubbing, couples choreography and a killer wedding-themed track. The sweet video starts with the future groom sitting his girlfriend down in the open trunk of his car with a pair of headphones. As he slowly drives off with her in the back, the music starts, and a huge group of their friends and family come out and lip-sync to Bruno Mars’ “Marry You.” It’s a heartwarming production, and you can tell that everyone involved is really excited to participate in their friends’ special day!

Go from zero to hero in five minutes: At James Allen or Blue Nile , you can adjust price ranges and other characteristics to see how many carats your budget buys. Their search tool is great. Their highly competitive pricing is too.

Logan and Jenna’s Central Park Flash Mob Marriage Proposal

When it comes down to it, the most memorable proposal is the one that shows that you’ve been paying attention in the relationship. This groom decided to bring the fireworks to his future bride in the most unexpected way by having a huge flash mob to Katy Perry’s “Firework” in the middle of the day in Central Park. It’s noted at the beginning of the video that the bride has been obsessed with fireworks since she was young, and this was a fresh new take on how to get sparks to fly on a seemingly average afternoon. And of course, she said yes!

Timothy and Audrey’s Meme-ified Proposal

If you and your lady are internet aficionados, then this kind of proposal is right up your alley. Timothy explains how much he loves his partner, “Love Actually” style, with a series of memes that explain why he wants to propose. It’s very funny (she’s giggling the entire time), but also incredibly thoughtful. Who knew that memes could make us tear up?

Chris and Pam’s Stolen-Car-Turned-Proposal

Chris calls himself a dramatic person in this video, and it’s easy to see why. Within a short, five-minute video, he literally finesses a fake stolen car scenario, picks up his future bride in a limo, and then has the driver give her a map which she used to find him waiting for her at a photo-worthy gazebo. Expertly-placed hidden cameras made it easy to see the whole proposal go down, but you can tell that neither of them care. This moment is clearly special to both of them, and you can definitely tell she appreciates the amount of effort he put into this proposal.

Don’t be a sucker: Buy rings from trusted online sources James Allen , Whiteflash , and Blue Nile . You’re guaranteed to find better and more in-depth information thanks to their videos and listing details.

Robin and Klara Take Their Proposal To New Heights

When you’re dating a helicopter pilot, it might be hard to think of a new and exciting idea that tops literally being able to fly. That’s why Robin took his future bride’s profession into account when he chose his method of proposal. Over the radio, he proposes, and she has to answer by landing on “yes” or “no.” While Robin cracks a joke that he make the “no” small so she wouldn’t land on it, it’s obvious that she was ready to say yes regardless!

Dean and Jennifer’s Year-Long Proposal

This one would take quite a bit of patience, but the pay-off is amazing . In this video, Dean took a short clip of himself every day for an entire year singing to Bruno Mars’ “Marry Me” and Pharell Williams’ “Happy” while he holds up a note saying “Will you marry me, Jen?” It takes some serious commitment to continue with this bit for a whole year, so you know if he can do this, he’s definitely able to take on the whole marriage thing! Not only is this kind of proposal low-budget, but it really does highlight how committed he is to her.

Matt and Ginny’s Movie-Worthy Love Story

Movie dates are super common, but movie proposals? Not so much. That’s what makes this particular proposal so special to watch. There are a few TV shows that make something like this look easy, but it’s cool to know that it can be done in real life, too!

 Puppies Make Good Ring Boxes

Skip the box, use a puppy to propose. If it’s not something the bride is interested in, then there’s no need to go all out and crazy to ask her to marry you. Plus, the puppy and the ring are a one-two punch combination that is sure to blow her out of the water. And who could say no to those puppy eyes (yours and the actual puppy’s)?

Bottom line: You get more sparkle for less dough at James Allen , Blue Nile , and Whiteflash .

Chris’ Surprise Musical Proposal At The Happiest Place On Earth

Good proposals take a lot of planning — and according to Chris, he said this process took him 5 months to plan! The best part about this surprise proposal is that the couple actually met at Disney World, so bringing it back to where their relationship began was key to making this proposal so meaningful. He gets major kudos for having someone create and recite an entire fairytale to have the couple act out before he proposes!

Mark and Sarah’s Virtual Reality Proposal

If you think you can’t create the perfect proposal in real life, then why not create the perfect one using virtual reality? Mark partnered with a VR artist to create a magical world that showcased some of the special moments from the couple’s lives. She thought they were going to go for a cool date night, but then he surprised her with this entirely personalized VR proposal — and this video shows everything she saw from her perspective!

Proposal Sample

Here’s a sample proposal to give you an idea of how it could be structured and written:

Subject : Proposal for Implementation of Environmental Education Program

I am pleased to submit this proposal for your consideration, outlining a comprehensive plan for the implementation of an Environmental Education Program. This program aims to address the critical need for environmental awareness and education among the community, with the objective of fostering a sense of responsibility and sustainability.

Executive Summary: Our proposed Environmental Education Program is designed to provide engaging and interactive educational opportunities for individuals of all ages. By combining classroom learning, hands-on activities, and community engagement, we aim to create a long-lasting impact on environmental conservation practices and attitudes.

Introduction: The state of our environment is facing significant challenges, including climate change, habitat loss, and pollution. It is essential to equip individuals with the knowledge and skills to understand these issues and take action. This proposal seeks to bridge the gap in environmental education and inspire a sense of environmental stewardship among the community.

Problem Statement: The lack of environmental education programs has resulted in limited awareness and understanding of environmental issues. As a result, individuals are less likely to adopt sustainable practices or actively contribute to conservation efforts. Our program aims to address this gap and empower individuals to become environmentally conscious and responsible citizens.

Proposed Solution or Project Description: Our Environmental Education Program will comprise a range of activities, including workshops, field trips, and community initiatives. We will collaborate with local schools, community centers, and environmental organizations to ensure broad participation and maximum impact. By incorporating interactive learning experiences, such as nature walks, recycling drives, and eco-craft sessions, we aim to make environmental education engaging and enjoyable.

Methodology: Our program will be structured into modules that cover key environmental themes, such as biodiversity, climate change, waste management, and sustainable living. Each module will include a mix of classroom sessions, hands-on activities, and practical field experiences. We will also leverage technology, such as educational apps and online resources, to enhance learning outcomes.

Evaluation and Success Metrics: We will employ a combination of quantitative and qualitative measures to evaluate the effectiveness of the program. Pre- and post-assessments will gauge knowledge gain, while surveys and feedback forms will assess participant satisfaction and behavior change. We will also track the number of community engagement activities and the adoption of sustainable practices as indicators of success.

Budget: Please find attached a detailed budget breakdown for the implementation of the Environmental Education Program. The budget covers personnel costs, materials and supplies, transportation, and outreach expenses. We have ensured cost-effectiveness while maintaining the quality and impact of the program.

Conclusion: By implementing this Environmental Education Program, we have the opportunity to make a significant difference in our community’s environmental consciousness and practices. We are confident that this program will foster a generation of individuals who are passionate about protecting our environment and taking sustainable actions. We look forward to discussing the proposal further and working together to make a positive impact.

Thank you for your time and consideration. Should you have any questions or require additional information, please do not hesitate to contact me at [your email address or phone number].

What marijuana reclassification means for the United States

The U.S. Drug Enforcement Administration will move to reclassify marijuana as a less dangerous drug, a historic shift to generations of American drug policy that could have wide ripple effects across the country.

WASHINGTON (AP) — The U.S. Drug Enforcement Administration is moving toward reclassifying marijuana as a less dangerous drug. The Justice Department proposal would recognize the medical uses of cannabis , but wouldn’t legalize it for recreational use.

The proposal would move marijuana from the “Schedule I” group to the less tightly regulated “Schedule III.”

So what does that mean, and what are the implications?

WHAT HAS ACTUALLY CHANGED? WHAT HAPPENS NEXT?

Technically, nothing yet. The proposal must be reviewed by the White House Office of Management and Budget, and then undergo a public-comment period and review from an administrative judge, a potentially lengthy process.

FILE - A marijuana plant is visible at a medical marijuana dispensary in Egg Harbor Township, N.J., March 22, 2019 The Biden administration's move to reclassify marijuana as a less dangerous but still illegal drug was hailed as a monumental step in reshaping national policy. But it appears it would do little to ease a longstanding problem in the industry, a lack of loans and banking services other businesses take for granted. (AP Photo/Julio Cortez, File)

Still, the switch is considered “paradigm-shifting, and it’s very exciting,” Vince Sliwoski, a Portland, Oregon-based cannabis and psychedelics attorney who runs well-known legal blogs on those topics, told The Associated Press when the federal Health and Human Services Department recommended the change.

“I can’t emphasize enough how big of news it is,” he said.

It came after President Joe Biden asked both HHS and the attorney general, who oversees the DEA, last year to review how marijuana was classified. Schedule I put it on par, legally, with heroin, LSD, quaaludes and ecstasy, among others.

Biden, a Democrat, supports legalizing medical marijuana for use “where appropriate, consistent with medical and scientific evidence,” White House press secretary Karine Jean-Pierre said Thursday. “That is why it is important for this independent review to go through.”

IF MARIJUANA GETS RECLASSIFIED, WOULD IT LEGALIZE RECREATIONAL CANNABIS NATIONWIDE?

Ap audio: what marijuana reclassification means for the united states.

AP correspondent Haya Panjwani reports on a proposal for the federal government to reclassify marijuana in what would be a historic shift that could have wide ripple effects across the country.

No. Schedule III drugs — which include ketamine, anabolic steroids and some acetaminophen-codeine combinations — are still controlled substances.

They’re subject to various rules that allow for some medical uses, and for federal criminal prosecution of anyone who traffics in the drugs without permission.

No changes are expected to the medical marijuana programs now licensed in 38 states or the legal recreational cannabis markets in 23 states, but it’s unlikely they would meet the federal production, record-keeping, prescribing and other requirements for Schedule III drugs.

There haven’t been many federal prosecutions for simply possessing marijuana in recent years, even under marijuana’s current Schedule I status, but the reclassification wouldn’t have an immediate impact on people already in the criminal justice system.

“Put simple, this move from Schedule I to Schedule III is not getting people out of jail,” said David Culver, senior vice president of public affairs at the U.S. Cannabis Council.

But rescheduling in itself would have some impact, particularly on research and marijuana business taxes.

WHAT WOULD THIS MEAN FOR RESEARCH?

Because marijuana is on Schedule I, it’s been very difficult to conduct authorized clinical studies that involve administering the drug. That has created something of a Catch-22: calls for more research, but barriers to doing it. (Scientists sometimes rely instead on people’s own reports of their marijuana use.)

Schedule III drugs are easier to study, though the reclassification wouldn’t immediately reverse all barriers to study.

“It’s going to be really confusing for a long time,” said Ziva Cooper, director of the University of California, Los Angeles Center for Cannabis and Cannabinoids. “When the dust has settled, I don’t know how many years from now, research will be easier.”

Among the unknowns: whether researchers will be able to study marijuana from state-licensed dispensaries and how the federal Food and Drug Administration might oversee that.

Some researchers are optimistic.

“Reducing the schedule to schedule 3 will open up the door for us to be able to conduct research with human subjects with cannabis,” said Susan Ferguson, director of University of Washington’s Addictions, Drug & Alcohol Institute in Seattle.

WHAT ABOUT TAXES (AND BANKING)?

Under the federal tax code, businesses involved in “trafficking” in marijuana or any other Schedule I or II drug can’t deduct rent, payroll or various other expenses that other businesses can write off. (Yes, at least some cannabis businesses, particularly state-licensed ones, do pay taxes to the federal government, despite its prohibition on marijuana.) Industry groups say the tax rate often ends up at 70% or more.

The deduction rule doesn’t apply to Schedule III drugs, so the proposed change would cut cannabis companies’ taxes substantially.

They say it would treat them like other industries and help them compete against illegal competitors that are frustrating licensees and officials in places such as New York .

“You’re going to make these state-legal programs stronger,” says Adam Goers, of The Cannabist Company, formerly Columbia Care. He co-chairs a coalition of corporate and other players that’s pushing for rescheduling.

It could also mean more cannabis promotion and advertising if those costs could be deducted, according to Beau Kilmer, co-director of the RAND Drug Policy Center.

Rescheduling wouldn’t directly affect another marijuana business problem: difficulty accessing banks, particularly for loans, because the federally regulated institutions are wary of the drug’s legal status. The industry has been looking instead to a measure called the SAFE Banking Act . It has repeatedly passed the House but stalled in the Senate.

ARE THERE CRITICS? WHAT DO THEY SAY?

Indeed, there are, including the national anti-legalization group Smart Approaches to Marijuana. President Kevin Sabet, a former Obama administration drug policy official, said the HHS recommendation “flies in the face of science, reeks of politics” and gives a regrettable nod to an industry “desperately looking for legitimacy.”

Some legalization advocates say rescheduling weed is too incremental. They want to keep the focus on removing it completely from the controlled substances list, which doesn’t include such items as alcohol or tobacco (they’re regulated, but that’s not the same).

Paul Armentano, the deputy director of the National Organization for the Reform of Marijuana Laws, said that simply reclassifying marijuana would be “perpetuating the existing divide between state and federal marijuana policies.” Kaliko Castille, a past president of the Minority Cannabis Business Association, said rescheduling just “re-brands prohibition,” rather than giving an all-clear to state licensees and putting a definitive close to decades of arrests that disproportionately pulled in people of color.

“Schedule III is going to leave it in this kind of amorphous, mucky middle where people are not going to understand the danger of it still being federally illegal,” he said.

This story has been corrected to show that Kaliko Castille is a past president, not president, of the Minority Cannabis Business Association and that Columbia Care is now The Cannabist Company.

Katie Britt shredded for 'Handmaid's Tale'-type proposal to 'register' pregnant women

U.S. Sen. Katie Britt (R-AL) is being ridiculed on social media for a new piece of proposed legislation that, while billed as a child support bill for new moms, is being panned as yet another dystopian intrusion into women's pregnancies.

Britt, who came to the forefront of the political conversation following her heavily-mocked response to President Joe Biden's 2024 State of the Union address, announced the More Opportunities for Moms to Succeed (MOMS) Act. The bill would create a registry of pregnant women, who would then be steered to support services that include "crisis pregnancy centers" — usually faith-based groups designed to shame or trick women seeking abortions into keeping their pregnancies anyway.

"To all of my fellow moms out there, my goal is to give you and your children the opportunities to thrive and to live your American dreams," Britt said in a video announcing the policy.

"Katie Britt: Introduced a bill to create a federal database of pregnant women. Also Katie Britt: Opposes federal database of gun owners," wrote Shannon Watts of Moms Demand Action.

@ArtCandee wrote, "Omg. Katie Britt has dropped a new super cringe video for introducing a bill to create a national registry of pregnant women. Clearly she didn’t learn her lesson about overacting and not coming across like a serial killer."

"This is Katie Britt, the Senator from Alabama, in her vanilla kitchen 98% of Americans could not afford," wrote @RogerZenAF. "She's talking about creating a database of pregnant women. Totally not cult behavior. Or fascism. Totally..."

Should trump be allowed to run for office, in-depth cnn review casts doubt on big trump trial gripe.

An in-depth CNN review of Donald Trump’s campaign calendar has exposed one of biggest courtroom gripes to be in doubt.

Trump has repeatedly complained that being forced into a courtroom while his criminal trial involving hush money payments continues has stopped him from campaigning.

“I should be right now in Pennsylvania, in Florida, in many other states, North Carolina, Georgia — campaigning,” he said outside the courtroom as the trial began.

The refrain has been repeated many times.

But, CNN found that, on almost all of the 12 court-free days he’s had since the trial started in April, he's spent his time on his golf resorts spent his time on his golf resorts in New Jersey, New York and Florida.

Barely any time has been given to campaign events or travel, the review showed.

“He did not use any of those 12 court-free days to visit Pennsylvania, Georgia, South Carolina, Ohio or New Hampshire, states he asserted the trial was preventing him from visiting,” CNN’s report revealed.

He has scheduled visit to a swing state on May 15, when he is expected in Ohio.

“Trump’s trial is not in session on Wednesdays, Saturdays and Sundays, and the judge also scheduled one Monday off in late April.

“As of this Saturday, May 11, that left Trump with 12 court-free days to do as he pleased, compared to 15 days where he was required in court, in the 27 days beginning with the opening of jury selection on April 15 ," CNN reported.

“Trump held no public events on seven of the 12 court-free days. And it was no public events on eight of the 12 days if you don’t count his one-minute-long appearance for the cameras prior to a private meeting with the president of Poland at Trump Tower in New York City.”

Since the trial started, Trump used one day off from court to rally in Wisconsin and Michigan .

He’s attended a fundraiser at his Mar-a-Lago home and is scheduled to rally Saturday in New Jersey, a Democratic Party stronghold.

“But he has let the majority of the 12 off days pass without doing any public campaign events,” CNN reported.

Instead, he has spent some of the time golfing at his Bedminster club in New Jersey , attending a Republican National Committee fundraiser at his Mar-a-Lago club and residence in Florida, attending a Mar-a-Lago dinner   for people who bought large numbers of his “NFT” digital trading cards , and making phone calls and holding meetings .”

U.S. Rep. Troy Nehls investigated that he used campaign money to pay rent to his company

" U.S. Rep. WASHINGTON — U.S. Rep. Troy Nehls , R-Richmond, is being investigated by his peers over allegations that he used campaign funds for his personal use, according to an Office of Congressional Ethics report released Friday.

The Ethics Committee announced it was investigating Nehls in March, but the details of the investigation were confidential. Nehls acknowledged in a statement at the time that the investigation was related to his campaign finances and said he would cooperate with the Ethics Committee.

Nehls’ campaign paid more than $25,000 in rent to a company called Liberty 1776 from 2019 to 2022, according to records with the Federal Election Commission. The company is registered to Nehls, who is listed in state records as the sole operator and proprietor. Nehl’s attorney responded that the business is in fact linked to his campaign.

The report said the Office of Congressional Ethics could not determine a legitimate campaign use for the payments to Liberty 1776. It is illegal to use campaign finances for purposes not related to running for office.

The campaign lists a different address than the company’s for its campaign headquarters, though the report notes that address does not appear to be currently used by the campaign. It was most recently an Islamic school and previously a bar, according to the report.

Liberty 1776 was registered in November 2019, according to the Texas Secretary of State — less than a month before it received the first rent payment from the campaign. The company is currently listed as inactive by the Secretary of State.

The Office of Congressional Ethics wrote and turned over the report to the House Ethics Committee in December of last year. The Ethics Committee made the report public Friday as it announced it would continue investigating the case.

In a January response to the report, an attorney for Nehls wrote that the payments to Liberty 1776 were legitimate rent payments for the campaign’s headquarters and events. The campaign set up Liberty 1776 to rent the space listed as its campaign headquarters as a limited liability company to “offer the typical liability protections important for such engagements” since the venue was expected to host large events.

The Ethics Committee is an evenly bipartisan panel of House members who investigate alleged violations of House rules and laws. U.S. Rep. Veronica Escobar, D-El Paso, is the only Texan on the committee. It is separate from the Office of Congressional Ethics, which was created in 2008 to investigate ethics complaints and refer cases to the House Ethics Committee. That office is run by nonpartisan full-time staff instead of elected officials.

The Office of Congressional Ethics said it had tried to interview staff from Nehls’ campaign and Liberty 1776 before referring the case to the House Ethics Committee, but they all refused.

“The Office of Congressional Ethics (OCE) was created under Nancy Pelosi, which is why I refused to cooperate with the office,” Nehls said in a statement. “My books remain open, and I am cooperating with the legitimate House Committee on Ethics.”

Nehls’ attorney also wrote in the response letter that members of Nehls’ staff had responded to OCE’s inquiries by requesting more information or informing the office that they worked only for Nehls’ congressional office and were not part of the campaign staff.

The House voted on a bipartisan basis to create the Office of Congressional Ethics in 2008, though the majority of yea votes were Democrats, who introduced the resolution to create the office.

Among the staff OCE requested to interview was Thomas Datwyler, who was listed as Nehls’ campaign treasurer. Datwyler is a career campaign compliance consultant who has worked on a host of Republican campaigns, including that of disgraced former Rep. George Santos, R-New York. Santos is under federal indictment for campaign finance violations.

Nehls said in a March statement that his "campaign has complied with every Federal Election Commission (FEC) law, and my books are open.”

Wearable devices can now harvest our brain data.

Recent trends show Australians are increasingly buying wearables such as smartwatches and fitness trackers. These electronics track our body movements or vital signs to provide data throughout the day, with or without the help of artificial intelligence (AI).

There’s also a newer product category that engages directly with the brain. It’s part of what UNESCO broadly defines as the emerging industry of “ neurotechnology ”:

devices and procedures that seek to access, assess, emulate and act on neural systems.

Much of neurotechnology is either still in development stage, or confined to research and medical settings. But consumers can already purchase several headsets that use electroencephalography (EEG) .

Often marketed as meditation headbands, these devices provide real-time data on a person’s brain activity and feed it into an app.

Such headsets can be useful for people wanting to meditate, monitor their sleep and improve wellness. However, they also raise privacy concerns – a person’s brain activity is intrinsically personal data. This is particularly concerning when it comes to EEG headsets and wearables designed for children.

The subtle creep in neural and cognitive data wearables are capable of collecting is resulting in a data “gold rush”, with companies mining even our brains so they can develop and improve their products.

A serious privacy concern

In a background paper published earlier this year, the Australian Human Rights Commission identified several risks to human rights that neurotechnology may pose, including rights to privacy and non-discrimination. Legal scholars, policymakers, lawmakers and the public need to pay serious attention to the issue.

The extent to which tech companies can harvest cognitive and neural data is particularly concerning when that data comes from children. This is because children fall outside of the protection provided by Australia’s privacy legislation , as it doesn’t specify an age when a person can make their own privacy decisions.

The government and relevant industry associations should conduct a candid inquiry to investigate the extent to which neurotechnology companies collect and retain this data from children in Australia.

The private data collected through such devices is also increasingly fed into AI algorithms, raising additional concerns. These algorithms rely on machine learning, which can manipulate datasets in ways unlikely to align with any consent given by a user.

What does the privacy law say?

Users should have complete transparency over what data their wearables collect, and how it is being used.

Currently, the Privacy Act and the Australian Privacy Principles govern the collection, use and disclosure of personal information in Australia.

Right now, Australians don’t have any legal protections from privacy infringement on their brain and cognitive data. Technology companies can mine the neural data of Australians – including children – and store this information outside Australia.

We urgently need to update the laws to provide more robust privacy protections for when neurotechnology comes into play. This would proactively protect the privacy of Australians of all ages at all times.

A child's hand in closeup tapping on a smartwatch screen.

With children having access to wearable devices, data privacy concerns intensify. StoryTime Studio/Shutterstock

How should we change the laws?

One potential solution would be to update our privacy legislation to work in conjunction with the Therapeutic Goods Administration (TGA), which regulates the supply of medical devices in Australia.

This would ensure wearables compatible with mobile apps and software that currently circumvent the TGA would fall within their stringent oversight. Such devices include fitness trackers and smartwatches, but also EEG headbands.

Doing this would mean these privacy-invasive technologies have to align with the TGA’s regulations, protecting the cognitive and neural data of Australians.

We could also establish additional data collection oversights to monitor neural data collection by companies within and outside Australia. This way, we could ensure compliance with privacy regulations and put into place measures that prevent unauthorised data collection or surveillance through wearables.

Such changes should also provide users with the right to access their neural and cognitive data. For example, users should always have the option to have their data permanently erased. Doing this would ensure that Australians’ data is treated in a transparent, ethical and legally sound manner.

Australia is at a pivotal crossroads. We need to address the risks associated with data harvesting through neurotechnology. The industry of devices that can access our neural and cognitive data is only going to expand.
