What marijuana reclassification means for the United States

WASHINGTON (AP) — The U.S. Drug Enforcement Administration is moving toward reclassifying marijuana as a less dangerous drug. The Justice Department proposal would recognize the medical uses of cannabis , but wouldn’t legalize it for recreational use.

The proposal would move marijuana from the “Schedule I” group to the less tightly regulated “Schedule III.”

So what does that mean, and what are the implications?


Technically, nothing yet. The proposal must be reviewed by the White House Office of Management and Budget, and then undergo a public-comment period and review from an administrative judge, a potentially lengthy process.

Still, the switch is considered “paradigm-shifting, and it’s very exciting,” Vince Sliwoski, a Portland, Oregon-based cannabis and psychedelics attorney who runs well-known legal blogs on those topics, told The Associated Press when the federal Health and Human Services Department recommended the change.

“I can’t emphasize enough how big of news it is,” he said.

It came after President Joe Biden asked both HHS and the attorney general, who oversees the DEA, last year to review how marijuana was classified. Schedule I put it on par, legally, with heroin, LSD, quaaludes and ecstasy, among others.

Biden, a Democrat, supports legalizing medical marijuana for use “where appropriate, consistent with medical and scientific evidence,” White House press secretary Karine Jean-Pierre said Thursday. “That is why it is important for this independent review to go through.”

AP correspondent Haya Panjwani reports on a proposal for the federal government to reclassify marijuana in what would be a historic shift that could have wide ripple effects across the country.

No. Schedule III drugs — which include ketamine, anabolic steroids and some acetaminophen-codeine combinations — are still controlled substances.

They’re subject to various rules that allow for some medical uses, and for federal criminal prosecution of anyone who traffics in the drugs without permission.

No changes are expected to the medical marijuana programs now licensed in 38 states or the legal recreational cannabis markets in 23 states, but it’s unlikely they would meet the federal production, record-keeping, prescribing and other requirements for Schedule III drugs.

There haven’t been many federal prosecutions for simply possessing marijuana in recent years, even under marijuana’s current Schedule I status, but the reclassification wouldn’t have an immediate impact on people already in the criminal justice system.

“Put simple, this move from Schedule I to Schedule III is not getting people out of jail,” said David Culver, senior vice president of public affairs at the U.S. Cannabis Council.

But rescheduling in itself would have some impact, particularly on research and marijuana business taxes.


Because marijuana is on Schedule I, it’s been very difficult to conduct authorized clinical studies that involve administering the drug. That has created something of a Catch-22: calls for more research, but barriers to doing it. (Scientists sometimes rely instead on people’s own reports of their marijuana use.)

Schedule III drugs are easier to study, though the reclassification wouldn’t immediately reverse all barriers to study.

“It’s going to be really confusing for a long time,” said Ziva Cooper, director of the University of California, Los Angeles Center for Cannabis and Cannabinoids. “When the dust has settled, I don’t know how many years from now, research will be easier.”

Among the unknowns: whether researchers will be able to study marijuana from state-licensed dispensaries and how the federal Food and Drug Administration might oversee that.

Some researchers are optimistic.

“Reducing the schedule to schedule 3 will open up the door for us to be able to conduct research with human subjects with cannabis,” said Susan Ferguson, director of University of Washington’s Addictions, Drug & Alcohol Institute in Seattle.


Under the federal tax code, businesses involved in “trafficking” in marijuana or any other Schedule I or II drug can’t deduct rent, payroll or various other expenses that other businesses can write off. (Yes, at least some cannabis businesses, particularly state-licensed ones, do pay taxes to the federal government, despite its prohibition on marijuana.) Industry groups say the tax rate often ends up at 70% or more.

The deduction rule doesn’t apply to Schedule III drugs, so the proposed change would cut cannabis companies’ taxes substantially.

They say it would treat them like other industries and help them compete against illegal competitors that are frustrating licensees and officials in places such as New York .

“You’re going to make these state-legal programs stronger,” says Adam Goers, of The Cannabist Company, formerly Columbia Care. He co-chairs a coalition of corporate and other players that’s pushing for rescheduling.

It could also mean more cannabis promotion and advertising if those costs could be deducted, according to Beau Kilmer, co-director of the RAND Drug Policy Center.

Rescheduling wouldn’t directly affect another marijuana business problem: difficulty accessing banks, particularly for loans, because the federally regulated institutions are wary of the drug’s legal status. The industry has been looking instead to a measure called the SAFE Banking Act . It has repeatedly passed the House but stalled in the Senate.


Indeed, there are, including the national anti-legalization group Smart Approaches to Marijuana. President Kevin Sabet, a former Obama administration drug policy official, said the HHS recommendation “flies in the face of science, reeks of politics” and gives a regrettable nod to an industry “desperately looking for legitimacy.”

Some legalization advocates say rescheduling weed is too incremental. They want to keep the focus on removing it completely from the controlled substances list, which doesn’t include such items as alcohol or tobacco (they’re regulated, but that’s not the same).

Paul Armentano, the deputy director of the National Organization for the Reform of Marijuana Laws, said that simply reclassifying marijuana would be “perpetuating the existing divide between state and federal marijuana policies.” Kaliko Castille, a past president of the Minority Cannabis Business Association, said rescheduling just “re-brands prohibition,” rather than giving an all-clear to state licensees and putting a definitive close to decades of arrests that disproportionately pulled in people of color.

“Schedule III is going to leave it in this kind of amorphous, mucky middle where people are not going to understand the danger of it still being federally illegal,” he said.

The bill would create a registry of pregnant women, who would then be steered to support services that include "crisis pregnancy centers" — usually faith-based groups designed to shame or trick women seeking abortions into keeping their pregnancies anyway.

"To all of my fellow moms out there, my goal is to give you and your children the opportunities to thrive and to live your American dreams," Britt said in a video announcing the policy.

But it didn't go over the way she was likely hoping on social media.

"Handmaid's Tale sh-- right here," wrote Allison Gill, the veteran and political commentator behind "Mueller, She Wrote." "What happened to the party of 'small government'?"

An in-depth CNN review of Donald Trump’s campaign calendar has exposed one of biggest courtroom gripes to be in doubt.

Trump has repeatedly complained that being forced into a courtroom while his criminal trial involving hush money payments continues has stopped him from campaigning.

“I should be right now in Pennsylvania, in Florida, in many other states, North Carolina, Georgia — campaigning,” he said outside the courtroom as the trial began.

The refrain has been repeated many times.

But, CNN found that, on almost all of the 12 court-free days he’s had since the trial started in April, he's spent his time on his golf resorts spent his time on his golf resorts in New Jersey, New York and Florida.

Barely any time has been given to campaign events or travel, the review showed.

“He did not use any of those 12 court-free days to visit Pennsylvania, Georgia, South Carolina, Ohio or New Hampshire, states he asserted the trial was preventing him from visiting,” CNN’s report revealed.

He has scheduled visit to a swing state on May 15, when he is expected in Ohio.

“Trump’s trial is not in session on Wednesdays, Saturdays and Sundays, and the judge also scheduled one Monday off in late April.

“As of this Saturday, May 11, that left Trump with 12 court-free days to do as he pleased, compared to 15 days where he was required in court, in the 27 days beginning with the opening of jury selection on April 15 ," CNN reported.

“Trump held no public events on seven of the 12 court-free days. And it was no public events on eight of the 12 days if you don’t count his one-minute-long appearance for the cameras prior to a private meeting with the president of Poland at Trump Tower in New York City.”

Since the trial started, Trump used one day off from court to rally in Wisconsin and Michigan .

He’s attended a fundraiser at his Mar-a-Lago home and is scheduled to rally Saturday in New Jersey, a Democratic Party stronghold.

“But he has let the majority of the 12 off days pass without doing any public campaign events,” CNN reported.

Instead, he has spent some of the time golfing at his Bedminster club in New Jersey , attending a Republican National Committee fundraiser at his Mar-a-Lago club and residence in Florida, attending a Mar-a-Lago dinner   for people who bought large numbers of his “NFT” digital trading cards , and making phone calls and holding meetings .”

WASHINGTON — U.S. Rep. Troy Nehls , R-Richmond, is being investigated by his peers over allegations that he used campaign funds for his personal use, according to an Office of Congressional Ethics report released Friday.

The Ethics Committee announced it was investigating Nehls in March, but the details of the investigation were confidential. Nehls acknowledged in a statement at the time that the investigation was related to his campaign finances and said he would cooperate with the Ethics Committee.

Nehls’ campaign paid more than $25,000 in rent to a company called Liberty 1776 from 2019 to 2022, according to records with the Federal Election Commission. The company is registered to Nehls, who is listed in state records as the sole operator and proprietor. Nehl’s attorney responded that the business is in fact linked to his campaign.

The report said the Office of Congressional Ethics could not determine a legitimate campaign use for the payments to Liberty 1776. It is illegal to use campaign finances for purposes not related to running for office.

The campaign lists a different address than the company’s for its campaign headquarters, though the report notes that address does not appear to be currently used by the campaign. It was most recently an Islamic school and previously a bar, according to the report.

Liberty 1776 was registered in November 2019, according to the Texas Secretary of State — less than a month before it received the first rent payment from the campaign. The company is currently listed as inactive by the Secretary of State.

The Office of Congressional Ethics wrote and turned over the report to the House Ethics Committee in December of last year. The Ethics Committee made the report public Friday as it announced it would continue investigating the case.

In a January response to the report, an attorney for Nehls wrote that the payments to Liberty 1776 were legitimate rent payments for the campaign’s headquarters and events. The campaign set up Liberty 1776 to rent the space listed as its campaign headquarters as a limited liability company to “offer the typical liability protections important for such engagements” since the venue was expected to host large events.

The Ethics Committee is an evenly bipartisan panel of House members who investigate alleged violations of House rules and laws. U.S. Rep. Veronica Escobar, D-El Paso, is the only Texan on the committee. It is separate from the Office of Congressional Ethics, which was created in 2008 to investigate ethics complaints and refer cases to the House Ethics Committee. That office is run by nonpartisan full-time staff instead of elected officials.

The Office of Congressional Ethics said it had tried to interview staff from Nehls’ campaign and Liberty 1776 before referring the case to the House Ethics Committee, but they all refused.

“The Office of Congressional Ethics (OCE) was created under Nancy Pelosi, which is why I refused to cooperate with the office,” Nehls said in a statement. “My books remain open, and I am cooperating with the legitimate House Committee on Ethics.”

Nehls’ attorney also wrote in the response letter that members of Nehls’ staff had responded to OCE’s inquiries by requesting more information or informing the office that they worked only for Nehls’ congressional office and were not part of the campaign staff.

The House voted on a bipartisan basis to create the Office of Congressional Ethics in 2008, though the majority of yea votes were Democrats, who introduced the resolution to create the office.

Among the staff OCE requested to interview was Thomas Datwyler, who was listed as Nehls’ campaign treasurer. Datwyler is a career campaign compliance consultant who has worked on a host of Republican campaigns, including that of disgraced former Rep. George Santos, R-New York. Santos is under federal indictment for campaign finance violations.

Nehls said in a March statement that his "campaign has complied with every Federal Election Commission (FEC) law, and my books are open.”

Wearable devices can now harvest our brain data.

Recent trends show Australians are increasingly buying wearables such as smartwatches and fitness trackers. These electronics track our body movements or vital signs to provide data throughout the day, with or without the help of artificial intelligence (AI).

There’s also a newer product category that engages directly with the brain. It’s part of what UNESCO broadly defines as the emerging industry of “ neurotechnology ”:

devices and procedures that seek to access, assess, emulate and act on neural systems.

Much of neurotechnology is either still in development stage, or confined to research and medical settings. But consumers can already purchase several headsets that use electroencephalography (EEG) .

Often marketed as meditation headbands, these devices provide real-time data on a person’s brain activity and feed it into an app.

Such headsets can be useful for people wanting to meditate, monitor their sleep and improve wellness. However, they also raise privacy concerns – a person’s brain activity is intrinsically personal data. This is particularly concerning when it comes to EEG headsets and wearables designed for children.

The subtle creep in neural and cognitive data wearables are capable of collecting is resulting in a data “gold rush”, with companies mining even our brains so they can develop and improve their products.

A serious privacy concern

In a background paper published earlier this year, the Australian Human Rights Commission identified several risks to human rights that neurotechnology may pose, including rights to privacy and non-discrimination. Legal scholars, policymakers, lawmakers and the public need to pay serious attention to the issue.

The extent to which tech companies can harvest cognitive and neural data is particularly concerning when that data comes from children. This is because children fall outside of the protection provided by Australia’s privacy legislation , as it doesn’t specify an age when a person can make their own privacy decisions.

The government and relevant industry associations should conduct a candid inquiry to investigate the extent to which neurotechnology companies collect and retain this data from children in Australia.

The private data collected through such devices is also increasingly fed into AI algorithms, raising additional concerns. These algorithms rely on machine learning, which can manipulate datasets in ways unlikely to align with any consent given by a user.

What does the privacy law say?

Users should have complete transparency over what data their wearables collect, and how it is being used.

Currently, the Privacy Act and the Australian Privacy Principles govern the collection, use and disclosure of personal information in Australia.

Right now, Australians don’t have any legal protections from privacy infringement on their brain and cognitive data. Technology companies can mine the neural data of Australians – including children – and store this information outside Australia.

We urgently need to update the laws to provide more robust privacy protections for when neurotechnology comes into play. This would proactively protect the privacy of Australians of all ages at all times.

How should we change the laws?

One potential solution would be to update our privacy legislation to work in conjunction with the Therapeutic Goods Administration (TGA), which regulates the supply of medical devices in Australia.

This would ensure wearables compatible with mobile apps and software that currently circumvent the TGA would fall within their stringent oversight. Such devices include fitness trackers and smartwatches, but also EEG headbands.

Doing this would mean these privacy-invasive technologies have to align with the TGA’s regulations, protecting the cognitive and neural data of Australians.

We could also establish additional data collection oversights to monitor neural data collection by companies within and outside Australia. This way, we could ensure compliance with privacy regulations and put into place measures that prevent unauthorised data collection or surveillance through wearables.

Such changes should also provide users with the right to access their neural and cognitive data. For example, users should always have the option to have their data permanently erased. Doing this would ensure that Australians’ data is treated in a transparent, ethical and legally sound manner.

Australia is at a pivotal crossroads. We need to address the risks associated with data harvesting through neurotechnology. The industry of devices that can access our neural and cognitive data is only going to expand.
